Terms of Service

Effective date: April 21, 2026

The short version. EarnedIt is a hobby app made for fun. It is not medical, nutritional, or fitness advice. Use it at your own risk, be kind, and don't try to reverse-engineer or redistribute it.

1. Agreement

These Terms of Service ("Terms") govern your use of the EarnedIt iPhone and Apple Watch applications and the website at earnedit.ron-media.com (together, the "Service"), provided by the EarnedIt developer ("we", "us", "our"). By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

2. License to use the app

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use EarnedIt on Apple devices that you own or control, for your personal, non-commercial use. All rights not expressly granted to you are reserved.

3. Not medical, nutritional, or fitness advice

Please read this one. EarnedIt is a playful calorie-counting toy. It displays a rough estimate of how many of a given food or drink item you've theoretically "earned" based on the active energy HealthKit reports for your device. It is not a dietary planner, a fitness coach, a weight management tool, or a substitute for professional advice.

The numbers shown in EarnedIt are approximations based on published average calorie values and whatever samples HealthKit has recorded — not measurements of what your body actually needs, consumed, or burned. Do not use EarnedIt to make decisions about your diet, exercise, medications, or health. Always consult a qualified healthcare professional for medical or nutritional advice.

EarnedIt sometimes includes alcoholic beverages among its built-in cravings (beer, wine, cocktails). Nothing in the app is an encouragement to drink, and the app is not intended for anyone under the legal drinking age in their jurisdiction. Drink responsibly or not at all.

4. Your content

You may create custom cravings with your own names, calorie values, and photos ("Your Content"). Your Content stays on your device — EarnedIt does not upload it anywhere. You represent that you have the right to use any photos you add, and that Your Content does not violate anyone else's rights or any applicable law.

5. Acceptable use

You agree that you will not:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent applicable law expressly prohibits this restriction.
Copy, modify, redistribute, resell, sublicense, or create derivative works of the app or website.
Use the Service in a way that could disable, damage, or impair Apple's platforms, HealthKit, or anyone else's devices.
Use the Service for any unlawful purpose, or to infringe the rights of others.

6. Beta / TestFlight

If you access EarnedIt through Apple's TestFlight program, you acknowledge that the app is pre-release software and may contain bugs, errors, or inaccuracies. Features may change or be removed at any time, and TestFlight builds expire on a schedule set by Apple. Use of TestFlight is also subject to Apple's own TestFlight terms.

7. Intellectual property

The EarnedIt name, logo, app, website, and their design and code are owned by the EarnedIt developer and protected by copyright and other intellectual property laws. Apple, HealthKit, iPhone, Apple Watch, TestFlight, and related marks are trademarks of Apple Inc., used here for descriptive purposes only. EarnedIt is an independent project and is not affiliated with or endorsed by Apple Inc.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the app will be error-free, uninterrupted, or that its calorie estimates are accurate for you.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event will the EarnedIt developer be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or personal injury — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service, which for the TestFlight beta is zero.

10. Third-party services

EarnedIt relies on Apple's HealthKit, WatchConnectivity, Image Playground, and (for distribution) TestFlight and the App Store. We are not responsible for the availability, accuracy, or behavior of those services, and your use of them is subject to Apple's own terms.

11. Termination

You may stop using EarnedIt at any time by deleting the app from your devices. We may suspend or discontinue the Service, or your access to it, at any time for any reason, including if you breach these Terms. Sections that by their nature should survive termination (disclaimers, limitation of liability, intellectual property) will continue to apply.

12. Changes to these Terms

We may update these Terms from time to time. If the changes are material, we'll bump the effective date above. Your continued use of the Service after the new date means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico, USA, without regard to its conflict-of-laws rules. You and we agree to submit to the exclusive jurisdiction of the courts located in San Juan, Puerto Rico for any dispute arising out of these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
